The most important amendment in the Bill of Rights and Rights of Incarcerated individuals? Why?

The Eighth Amendment of the Bill of Rights is probably the most important for incarcerated individuals as it protects three rights of the individual (Harr & Hess, 2007). The rights it protects include a prohibition against excessive bail, excessive fines and cruel and unusual punishment (Harr & Hess, 2007). This is probably the most important amendment as it guarantees the incarcerated is not treated unfairly during trial and during incarceration.
